Welcome to Jayla Health. These Terms & Conditions (“Terms”) govern your access to and use of our website, applications, and virtual menopause care services (collectively, the “Services”). Please read them carefully.
1. Acceptance of these terms
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services. If you are using the Services on behalf of another person, you represent that you have authority to do so.
2. Description of services
Jayla Health is a virtual clinic offering telehealth consultations, optional at-home laboratory testing, personalized treatment planning, and ongoing messaging support focused on perimenopause and menopause. Clinical services are provided by licensed healthcare professionals practicing within the states where they are authorized. The Services do not create a continuous primary-care relationship and are intended to complement, not replace, your primary care provider or OB-GYN.
3. Not for emergencies
The Services are not designed for urgent or emergency medical needs. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use the Services to request emergency assistance. Telehealth has inherent limitations, including the inability to perform a physical examination.
4. Eligibility & accounts
You must be at least 18 years old and located in a state where our clinicians are licensed to use the clinical Services. You agree to provide accurate, complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
5. Membership & billing
Certain Services are offered on a recurring membership basis. By enrolling, you authorize us to charge your payment method the applicable fees on a recurring basis until you cancel. Membership fees cover clinical visits and messaging support; medications, laboratory kits, and certain services are billed separately. Prices are displayed before purchase and may change with notice. Jayla is a cash-pay service and does not bill insurance directly, though we can provide superbills on request.
6. Prescriptions & pharmacy
Any prescription is issued solely at the independent clinical judgment of your treating clinician and only when medically appropriate. We do not guarantee that a prescription will be issued. Prescriptions may be fulfilled by our partner pharmacy or a pharmacy of your choosing. You are responsible for using medications as directed and for disclosing your complete medical history.
7. Cancellations & refunds
You may cancel a monthly membership at any time; access continues through the end of the current billing period, and cancellation stops future charges. Annual memberships may be eligible for a prorated refund as described at the point of sale. Laboratory kits and dispensed medications are generally non-refundable once shipped. 8. Intellectual property
All content on the Services — including text, graphics, logos, and software — is owned by or licensed to Jayla Health and protected by applicable intellectual-property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
9. Disclaimers
The Services and all content are provided “as is” without warranties of any kind, express or implied. Educational content on the Services is for general information only and is not individualized medical advice. We do not warrant that the Services will be uninterrupted, error-free, or that any particular health outcome will be achieved.
10. Limitation of liability
To the fullest extent permitted by law, Jayla Health and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for the professional negligence of a treating clinician.
11. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in New York County, New York, unless otherwise required by applicable law.
12. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
